Rules for using the BaliaGo website, placing orders, and the general conditions for sales and services.

1. General provisions 1.1. These Terms and Conditions set out the rules for using the BaliaGo website, submitting enquiries and orders, and the general conditions for the sale of goods and provision of services related to the BaliaGo offer. 1.2. The Terms apply to agreements concluded with customers who use the website or contact BaliaGo via the contact form, email, telephone, or any other channel indicated by the Seller. 1.3. To the extent that mandatory law grants consumers broader protection than these Terms, mandatory law prevails. 2. Definitions 2.1. Website means the BaliaGo website together with its language versions. 2.2. Seller or Service Provider means the entity operating under the BaliaGo brand, whose full registration details are indicated in section 3.6 of these Terms. 2.3. Customer means any natural person, legal person, or organisational unit using the Website, submitting an enquiry, or concluding an agreement with the Seller. 2.4. Consumer means a Customer acting for purposes outside their trade, business, craft, or profession. 2.5. Goods means, in particular, garden hot tubs, mobile hot tubs, outdoor saunas, accessories, and other products offered by BaliaGo. 2.6. Services means, in particular, consultation, quotation preparation, delivery coordination, installation, commissioning, or other services agreed individually. 3. Seller details and contact 3.1. Scope of the Website and nature of information 4.1. The Website has both informational and sales functions. It presents the offer, enables contact with an advisor, and supports preparation of individual quotations. 4.2. Unless expressly stated otherwise, information published on the Website does not constitute a binding offer but an invitation to contact BaliaGo and begin the quotation process. 4.3. Descriptions, photos, visualisations, colours, and material references are indicative within the limits permitted by law. The binding specification of a given order is confirmed in the quotation, specification, or order confirmation. 4.4. If an individual offer concerns a used, display, or outlet product, this should be stated in that offer or product description, and that description forms part of the contract. 5. Rules for using the Website 5.1. Customers must use the Website lawfully, in good faith, and in line with its intended purpose. 5.2. It is prohibited to provide unlawful content, infringe third-party rights, interfere with the functioning of the Website, or attempt unauthorised access. 5.3. The Seller takes reasonable steps to keep the Website available, but access may be temporarily limited for technical, maintenance, or security reasons. 6. Enquiries, quotations, and conclusion of the contract 6.1. Customers may contact the Seller to receive information, recommendations, an initial estimate, or an individual quotation. 6.2. Orders may be placed in the manner agreed with the Seller, especially by accepting an individual quotation, an order confirmation, an email confirmation, or another durable medium. 6.3. The contract is concluded when the Seller confirms acceptance of the order or in another way expressly stated in the order documents. 6.4. The scope of supply, price, delivery date, installation scope, and any additional conditions are set out in the quotation, specification, and order confirmation for the relevant project. 7. Prices and payments 7.1. Prices are stated individually in the quotation or next to a given product. Unless stated otherwise, the price covers only the scope expressly described in the offer. 7.2. Additional costs, including transport, lifting, installation, auxiliary equipment, site preparation, or related services, are indicated separately where not included in the main price. 7.3. Available payment methods and payment deadlines are set out in the quotation, pro forma invoice, order, or order confirmation. 7.4. If a deposit, staged payment, or final balance applies to a project, that information is provided before the contract is concluded. 8. Delivery, acceptance, and installation 8.1. Goods are delivered to the address agreed with the Customer. 8.2. Delivery and installation dates are agreed individually, taking into account the type of order, level of customisation, destination, product availability, and site readiness. 8.3. The Customer must ensure the conditions required for delivery or installation as communicated by the Seller before performance, including access, suitable foundation, utilities, and the absence of obstacles preventing safe works. 8.4. If installation or commissioning is not included in the order, the Seller's obligations are limited to the scope expressly indicated in the offer. 8.5. The moment when risk transfers is determined by applicable law and the relevant contract. 9. Consumer withdrawal rights 9.1. As a general rule, a consumer who concludes a distance or off-premises contract has a statutory right to withdraw without giving reasons within the legal period. Detailed rules are described in the Returns and Complaints page. 9.2. The right of withdrawal may not apply in cases provided by law, including non-prefabricated goods made to the consumer's specification or clearly personalised goods, as well as services fully performed after the consumer's prior express consent and acknowledgement of the consequences. 10. Lack of conformity, complaints, and guarantee 10.1. The Seller is liable to consumers for any lack of conformity of the goods with the contract in accordance with applicable law. 10.2. Consumers may exercise statutory remedies for lack of conformity, and the general rules for complaints and withdrawal are described in the Returns and Complaints page. 10.3. If a commercial guarantee is granted for a given product, its scope, duration, and procedure follow the separate guarantee statement. A guarantee does not exclude, limit, or suspend statutory consumer rights. 11. Liability 11.1. The Seller is liable for non-performance or improper performance in accordance with applicable law. 11.2. Nothing in these Terms excludes or limits mandatory consumer rights. 11.3. In B2B relationships, liability is subject to applicable law and any individually agreed contract terms where permitted by law. 11.4. The Seller is not liable for delays or impossibility of performance caused by circumstances beyond its reasonable control, including force majeure, without prejudice to mandatory consumer rights. 12. Intellectual property 12.1. Rights to the Website, its layout, texts, photographs, graphics, marks, marketing materials, and branding elements belong to the Seller or relevant right holders. 12.2. Any use beyond permitted use requires prior consent of the relevant right holder. 13. Personal data 13.1. Personal data processing rules are set out in the separate Privacy Policy. 13.2. Privacy-related enquiries may be sent using the Seller's contact details. 14. Changes to the Terms 14.1. The Seller may amend these Terms for valid reasons, especially changes in law, changes to the business model, changes to the offer or contact channels, or the need to clarify provisions. 14.2. Amendments do not affect rights acquired before the changes enter into force. Orders already accepted remain governed by the version applicable when the contract was concluded, unless mandatory law provides otherwise. 15. Governing law and disputes 15.1. Contracts with the Seller are governed by Polish law, without prejudice to mandatory protections available to consumers in their country of habitual residence where applicable. 15.2. Jurisdiction is determined by applicable law. 16.
